4. RIGHT OF RETURN
Sales of products online on commercial sites are qualified as "distance contracts" and are regulated by the Consumer Code (Legislative Decree 206/2005 as amended by Legislative Decree 21/2014) in Articles 51-67.
Pursuant to the Consumer Code (Legislative Decree 206/2005) as amended by Legislative Decree 21/2014, the Customer who signs a distance contract, has the right to withdraw from the purchase contract for any reason, without needing to provide explanations.
The right of withdrawal provided for by art. 49 paragraph 4 legislative decree 206/2005 can be exercised by the Customer within the term of 14 (fourteen) days from receipt of the purchased goods.
The Client who intends to exercise the right of withdrawal must communicate to Nce Srl his / her will to exercise this right.
The right of withdrawal can be exercised exclusively by the customer-consumer, or the natural person who buys the goods for purposes not related to his professional activity and therefore does not indicate a VAT reference in the order form, pursuant to the combined of articles 3 and 52 Consumer Code Legislative Decree 206/2005 as amended.
Therefore, it should be noted that customers who purchase with a VAT number cannot exercise the right of withdrawal.
The withdrawal cannot be exercised in the absence of the original packaging, of all the elements accompanying the product and anything else present in the original packaging.
It is not possible to exercise the withdrawal only on part of the purchased product.
4.1. Method of withdrawal
Within 14 days from the date of delivery of the goods the consumer must send a communication by means of RECOMMENDED with return receipt to:

After receiving the registered letter from Nce Srl relating to the communication of withdrawal from the purchase contract, the company's Customer Service will contact the consumer by telephone or by e-mail to accept the request, if the conditions exist and confirm the possible shipment of the pack.
The right of withdrawal presupposes the substantial integrity of the good received.
The goods must therefore be carefully packaged by the Customer to avoid damage during shipment. The original packaging must be used and the product must be complete with everything originally contained. We advise you to make the insured shipping with express courier.
The Customer - Consumer who exercises the right of withdrawal, is required pursuant to art. 57 of the Consumer Code, to return the goods to Nce SrL at its own expense and without undue delay, and in any case within 14 days from the date on which it communicated to the Seller the intention to withdraw from the contract; the Customer is responsible for the product during shipment. In the event of loss, theft, or other, Nce Srl reserves the right to charge for any damages incurred.
Within 14 days from the acceptance of withdrawal by Nce Srl the customer must send the product by courier.
Upon arrival of the goods N.C.E. S.r.L will check the integrity of the goods and the presence of all the products accompanying the original product, in order to assess the existence of all the conditions for the correct exercise of the right of withdrawal.
The company will reimburse all payments received from the consumer, possibly including delivery costs, without undue delay and in any case within 14 days from the day on which the products subject to withdrawal request were received.
The company will carry out the reimbursement using the same means of payment used by the consumer for the initial transaction, unless the consumer has expressly agreed otherwise and provided that he does not incur any costs as a result of the reimbursement.
The consumer is only responsible for the decrease in the value of the goods resulting from the handling of goods other than that necessary to establish the nature, characteristics and functioning of the goods.
To establish the nature, characteristics and functioning of the goods, the consumer should only manipulate and inspect them in the same way as he would be allowed to do in a store.
Consequently, during the withdrawal period the consumer should manipulate and inspect the goods with due diligence (art. 57 Consumer Code D.lgs.206 / 2005).
In the event of damage to the product during transport, Nce Srl will notify the Customer of what happened (within five working days from receipt of the product in its warehouses), to allow the customer to immediately report a complaint to the courier chosen by him and obtain reimbursement of the value of the product (if insured by the customer).
